These Terms constitute a legally binding agreement between you and Vstager. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Vstager provides an AI-powered video generation platform that allows users to:

  • Generate videos from text prompts (text-to-video)
  • Create videos from images (image-to-video)
  • Enhance videos using reference materials (reference-to-video)
  • Purchase credits and manage subscriptions
  • Store and download generated content

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. User Accounts and Registration

3.1 Account Creation

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

3.2 Account Security

  • You agree to notify us immediately of any unauthorized use of your account
  • You are liable for any actions taken through your account, whether or not you authorized those actions
  • We are not responsible for any loss or damage arising from your failure to protect your account information

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. Acceptable Use Policy

4.1 Permitted Use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

4.2 Prohibited Activities

You must NOT:

  • Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Create deepfakes or misleading content of real individuals without consent
  • Infringe on intellectual property rights of others
  • Generate violent, pornographic, or discriminatory content
  • Attempt to circumvent usage limits or credit systems
  • Reverse engineer or attempt to extract our AI models or algorithms
  • Use automated tools to abuse the Service (bots, scrapers, etc.)
  • Interfere with or disrupt the Service or servers
  • Use the Service to spam or harass others

4.3 Content Moderation

We reserve the right to review, moderate, or remove any content generated through the Service that violates these Terms or applicable laws. We may also report violations to law enforcement authorities.

5. Intellectual Property Rights

5.1 Service Ownership

The Service, including all technology, software, and AI models, is owned by Vstager and is protected by intellectual property laws. You do not acquire any ownership rights in the Service.

5.2 User Content

You retain ownership of content you upload to the Service. By uploading content, you grant us a license to use, process, and store that content solely to provide the Service to you.

5.3 Generated Content

You own the videos generated through the Service, subject to these Terms and applicable law. However, you acknowledge that:

  • Generated content may not be unique or original
  • You are responsible for ensuring your use of generated content complies with applicable laws
  • We do not guarantee that generated content will not infringe on third-party rights

5.4 Trademarks

Vstager, our logo, and other trade names are trademarks of Vstager. You may not use our trademarks without our prior written consent.

6. Payment Terms

6.1 Credits and Subscriptions

  • Credits are purchased in packages or through subscriptions
  • Credits expire according to the terms of your purchase
  • Credits are consumed when generating videos based on model, duration, and quality
  • Subscription plans auto-renew unless cancelled

6.2 Refund Policy

We offer refunds under the following conditions:

  • Failed Generations: Credits are automatically refunded if video generation fails
  • 7-Day Guarantee: You may request a refund within 7 days of your first purchase, provided you have not used more than 10% of the purchased credits
  • Subscription Refunds: Pro-rated refunds available within 7 days of subscription start

6.3 Price Changes

We reserve the right to modify pricing at any time. Price changes will apply to new purchases only, not to existing credits or subscriptions.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF GENERATED CONTENT

We do not guarantee that the Service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VSTAGER SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
  • DAMAGES RESULTING FROM USE OR INABILITY TO USE THE SERVICE
  • CONTENT GENERATED BY THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Vstager and its affiliates from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you create or distribute using the Service

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting support or using the account settings. You will not receive a refund for any unused credits or subscription fees.

11.2 Termination by Us

We may suspend or terminate your account immediately if:

  • You violate these Terms
  • You engage in fraudulent or illegal activities
  • Your account poses a security risk to the Service

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account data and generated content according to our retention policies.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the jurisdiction in which Vstager is established, without regard to conflict of law principles.

12.2 Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.

13. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Vstager
  • Waiver: Failure to enforce any provision does not constitute a waiver
  • Severability: If any provision is found invalid, the remaining provisions remain in effect
  • Assignment: You may not assign these Terms without our consent
  • Force Majeure: We are not liable for delays or failures caused by events beyond our control

14. AI-Specific Provisions

You acknowledge and agree that:

  • AI-generated content may not always be accurate or appropriate
  • You are responsible for reviewing and validating all generated content before use
  • AI models may produce unexpected or unintended results
  • We continuously improve our AI models, which may affect output quality and characteristics
